Mike, I have another story for you. Tip has a gravel pit out at Buckhorn, NM. The pit comes under the authority of MSHA (Mine Safety Health Act). The inspectors try and visit him but they cannot notify him ahead of time (by regulation) that they are coming. This last inspector, has been trying since January, and finally caught up with him, after calling the house, earlier this month. Tip operates the pit alone, has no employees, but takes his two dogs with him when he can. The pit is on MSHA records as an intermittent operation. To most of us, that means he isn’t there all the time. Technically, is he supposed to notify MSHA every time he “opens” or “closes” the pit. That means on Monday, he says he isn’t there, and on Wednesday he says he is. Can you imagine the horror of the paper work?
Several years ago, Tip was told that he HAD to buy a stretcher, so it would be on hand in case of an accident. We assume that is so the dogs can load him on the stretcher and drive him to town. There is no phone service out in Sacaton Creek, but he must notify MSHA within 15 minutes of an accident. He must also have a first aid class, and then an annual refresher. I would think they would want the dogs to have the class so they could assist Tip before they put him on the stretcher!
Several conversations with the various MSHA inspectors have not resulted in any semblance of intelligence concerning the regulations and a single operator business. They just shrug their shoulders and say, “these are the rules”.
Ah – our government!
PS – we are looking for someone to teach a first aid refresher course before October 9, 2009. They can call us at 538-9696.
